Subject: Update From the Cell Tower Committee
Neighborhood,
I wanted to say thanks to all the individuals from our neighborhood for supporting our efforts in appealing, and ultimately, establishing the removal of the cell tower erected in our back yards. The turnout at last night's City Council meeting and support throughout this process has been tremendous. We are very proud to be living in a community with people who care for and support one another to band together to do what is right. -Thank you!
Our hard work and diligence has paid off - - We Won! Last night, the Albuquerque City Council unanimously voted to approve our appeal to have the 65' concealed wireless telecommunication tower removed from the current site. Also, two additional findings were unanimously approved by the council members as read by Mr. Thompson. They were:
1.. " (Cingular's) Failure to preserve and present a design that was architecturally integrated with existing buildings, structures and landscaping to include height, color, style, massing, placement, design and shape".
2.. " (Cingular's) Failure to consider minimizing adverse effects on residential property values".
This, I believe, will help us with our future appeal if and when Cingular puts in an application to install a larger full array in the place of the existing "concealed" monopole - as they so aptly stated (threatened) last night.
Also, after the council voting was completed and the Council members were on to the next order of business, Dave Nufer and I talked with Mr. Thompson to get an idea of what happens next. As we were told, the decision will now go to the enforcement side of the planning department to have the current monopole and facility removed. It is now up to that department to enforce the Council's decision. It was clear Mr. Thompson did not know how and when this would occur. He used the example that "if you built a chicken coupe in your back yard and it went against code/zoning, this same enforcement side of the planning department would make you remove it".
So, our next step is to work with the city councilors to make sure the planning department follows thru with their unanimous decision. We, the cell tower committee, will be working that issue soonest.
